What is Caaring?

Caaring® is a digital platform for remote monitoring of patients that helps improve the management and course of diseases and generate Real-World Evidences. This platform enables the collection of real-life data about the patient’s status and treatment, at the same time as it facilitates educational content of interest for the management of the disease. The healthcare professional carries out the monitoring of the clinical data provided in Caaring® with the goal of managing the course of the disease and preventing an increase in the severity of that disease. The Caaring® platform is put at the disposal of the user at no cost through the healthcare professional, who is the person responsible for facilitating the platform for the patient to carry out the monitoring of the disease.

1.- Right to information

We inform you that the “Caaring” App (hereinafter, the "App") is owned by Persei Vivarium, S.L. (hereinafter, "PERSEI"), with tax identification number B87263885, and registered office at Gran Vía 62, 5º, 28013, Madrid (Spain).

Access and/or use of the App confers the condition of user, and accepts, from said access and/or use, this Legal Notice and, where appropriate, the changes made to it.

2.- Use of the App

The User assumes responsibility for the use of the App. The App may provide access to a multitude of texts, graphics, drawings, designs, photographs, multimedia content, and information (hereinafter "Content") belonging to PERSEI or third parties to which the User may have access.

The User undertakes to make appropriate use of the Contents and services offered through the App and, by way of example, but not limited to, not to use them for:

(i) Engaging in activities that are unlawful, illegal, or contrary to good faith and public order.
(ii) Causing damage to the physical and logical systems of the PERSEI App, its suppliers, or third parties.
(iii) Introducing or disseminating laptop viruses or any other physical or logical systems capable of causing any damage.
(iv) Attempting to access, use and/or manipulate the data of PERSEI, third-party providers, collaborating entities, and other users.
(v) Reproducing or copying, distributing, making available to the public by any means of public communication, transforming, or modifying the Content, unless authorized by PERSEI.
(vi) Deleting, concealing, or manipulating the Contents subject to intellectual or industrial property rights and other data identifying the said rights of PERSEI or third parties incorporated in the Contents, as well as the technical protection devices or any information mechanisms that may be inserted in the Contents.

PERSEI advises that the materials contained in this App are included for information purposes only and may not be sufficient to make any decisions or take any position in any case.

The User should be aware that the materials contained in this App may not reflect the latest legislative or case law status on the issues discussed. Furthermore, these materials may be modified, developed, or updated without prior notice.

PERSEI shall have the right to investigate and report any of the conduct in accordance with the Law and to cooperate with the authorities in the investigation of such conduct.

PERSEI may temporarily suspend access to the App without prior notice for maintenance, repair, updating, or improvement operations. However, whenever circumstances permit, PERSEI will give the User sufficient notice of the date on which the services are due to be suspended. PERSEI is not responsible for the use that Users may make of the Content included on the App.

3.- Intellectual Property

Each and every one of the intellectual property rights over the content and graphic design of this App (including, but not limited to, images, sound, audio, video, software, or text; trademarks or logos, color combinations, structure and design, selection of materials used, laptop programs necessary for its operation, access and use, etc.) are the exclusive property of PERSEI or of a third party to whom PERSEI has authorized its use. Therefore, PERSEI has the exclusive right to exploit such content and graphic design.

Therefore, the reproduction, transmission, adaptation, translation, distribution, or public communication, including making available or any other form of commercial exploitation and/or modification of all or part of the content of the App is prohibited, except with the express prior authorization of PERSEI.

PERSEI does not grant any license or authorization to use any of its intellectual property rights or any other property or rights relating to the App and/or the services or content on the App.

The User undertakes to respect the Intellectual Property rights owned by PERSEI. In this regard, the reproduction and temporary storage of the contents of the App is permitted insofar as this is strictly necessary for the use and viewing of the App from a laptop/Tablet or personal telephone.

The legitimacy of the intellectual property rights over the content provided by Users is the exclusive responsibility of the Users themselves, who shall be liable for any claim by third parties arising from the unlawful use of the content of the App.

4.- Data protection

The use of this App may require Users to provide personal data. PERSEI processes this type of information in accordance with applicable law and sets it out in its Privacy Policy https://www.caaring.com/privacy-policy-en.php.

5.- Liability and Guarantees

PERSEI declares that it has taken all necessary measures, within its capabilities and taking into account the current state of technology, to ensure the proper functioning and the absence of viruses and harmful components on its App.

However, PERSEI cannot be held liable for:

(i) The lack of continuity and availability of the Contents and Services;
(ii) The presence of errors in such Content or the failure to correct any defects that may exist;
(iii) The veracity, integrity, or updating of the data provided by Users;
(iv) The interruption of the operation of the App or laptop failures, telephone breakdowns, disconnections, delays, or blockages caused by deficiencies or overloads in the telephone lines, data centers, in the Internet system, or in other electronic systems, produced in the course of its operation;
(v) The presence of viruses or other harmful components;
(vi) Any damage caused by third parties who breach or violate PERSEI's security systems.

PERSEI may temporarily suspend access to the App without prior notice for maintenance, repair, updating, or improvement. However, whenever circumstances permit, PERSEI will give the User sufficient notice of the date on which the Services are due to be suspended.

PERSEI is not responsible for the use that Users may make of the content included on the App.

6.- Duration and modification

This Legal Notice shall be in force indefinitely, and PERSEI may make changes to the conditions specified in it, which shall come into force from the time of its publication.

PERSEI may delete, add, or change both the content and the services it provides, as well as the way in which they are located or presented. The Legal Notice published at the time the User accesses the PERSEI App shall be deemed to be in force.

Access to and/or use of the App shall be understood as acceptance by the User of this Legal Notice and its conditions and, where applicable, any changes made to them.

7.- Hyperlinks

PERSEI assumes no responsibility for any third-party links, applications, or Apps made available on the PERSEI App and which may direct the User to other applications or Apps over which PERSEI has no control.

In this respect, PERSEI is not responsible for the information contained in these third-party links or for any effects that may derive from this information.

Therefore, the inclusion of links to other Apps or applications does not imply endorsement of their content by PERSEI or any association between PERSEI and their owners.

Consequently, the User accesses the content under his or her sole responsibility and under the conditions of use that govern the same.

8.- Safeguarding and interpretation

This Legal Notice constitutes an agreement between each User and PERSEI.

If the competent authority declares a provision to be illegal, invalid, or unenforceable, such a declaration in respect of one or more clauses shall be without prejudice to the validity of the other clauses.

PERSEI's failure to require strict compliance with any of the provisions of this Legal Notice does not constitute and shall not be construed in any way as a waiver by PERSEI of its right to require strict compliance in the future.

9.- General Information

PERSEI will pursue the breach of this Legal Notice, as well as any improper use of its portal, exercising all civil and criminal actions that may correspond to it by law.
